These Terms & Conditions of Sale and Service apply to purchases made directly through the AKIZAKURA website, private kimono experience services provided by AKIZAKURA, and certain other transactions entered into directly with AKIZAKURA.
Purchases made through third-party platforms such as Etsy are also subject to the terms and policies applicable on those platforms.
Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.

- Scope of These Terms
These Terms apply to:
- purchases of vintage kimono, haori, accessories, and related items made directly through the AKIZAKURA website;
- private kimono experience services booked directly with AKIZAKURA;
- other products or services where these Terms are expressly incorporated into the transaction.
By placing an order or making a confirmed booking directly with AKIZAKURA, the customer agrees to the version of these Terms applicable at the time of the transaction.
For purchases or bookings made through a third-party platform, such as Etsy, GetYourGuide, Airbnb, Viator, or another booking or marketplace service, the conditions displayed on that platform may also apply.
- Products and Vintage Condition
Many of the kimono, haori, accessories, and related items sold by AKIZAKURA are vintage, pre-owned, or one-of-a-kind pieces.
Because of their age and history, vintage items may include characteristics such as:
- age-related changes in color;
- small stains, marks, rubbing, or loose threads;
- fold lines from storage;
- minor changes in the fabric or lining;
- previous repairs or stitching;
- variations resulting from traditional craftsmanship.
These characteristics are part of the nature of vintage textiles and do not automatically constitute defects.
AKIZAKURA makes reasonable efforts to photograph and describe the condition of each item accurately, including significant visible imperfections of which we are aware.
Customers are encouraged to review all photographs, measurements, condition notes, and product descriptions carefully before placing an order.
Where a particular characteristic, mark, wear, repair, or other feature is clearly disclosed before purchase, it forms part of the description of the item, subject to the customer’s mandatory legal rights.
- Product Information and Measurements
Product photographs are intended to represent the item as accurately as reasonably possible.
Colors may appear slightly different depending on lighting conditions, screen calibration, device settings, or photographic conditions.
All measurements are approximate.
For garments such as haori and kimono, customers are responsible for reviewing the measurements provided and determining whether the item is suitable for their intended fit or styling.
Where the composition of a vintage textile cannot be confirmed by an original label, AKIZAKURA will describe the material according to the information reasonably available to us.
- Orders and Contract Formation
Before submitting an order, customers have the opportunity to review the products selected, quantities, prices, delivery information, shipping costs, and total amount and to correct errors where necessary.
Submitting the final order constitutes an obligation to pay.
After an order is submitted, an electronic acknowledgement or order confirmation is sent to the email address provided by the customer.
Payment must be successfully authorised for the order to proceed.
AKIZAKURA may contact the customer if additional information is reasonably required to process the order, verify payment, prevent fraud, or arrange delivery.
An order may be refused or cancelled where:
- payment is refused or cannot be verified;
- the transaction is reasonably suspected to be fraudulent or unlawful;
- the delivery destination is not supported;
- the item is no longer available because of an exceptional stock discrepancy;
- a clear technical or pricing error has occurred.
Where payment has already been collected for an order that AKIZAKURA cannot fulfil, the amount paid will be refunded without undue delay.
French e-commerce rules require customers to be able to review and correct their order before confirming it and to be clearly informed that the final action creates an obligation to pay. Service Public
- Availability and One-of-a-Kind Items
Many AKIZAKURA products are unique and available in a quantity of one.
Some items may also be offered through another AKIZAKURA sales channel, such as Etsy.
AKIZAKURA makes reasonable efforts to update availability promptly after a sale.
In the exceptional event that the same one-of-a-kind item becomes unavailable before the inventory on another sales channel has been updated, AKIZAKURA will inform the affected customer as soon as reasonably possible and issue a full refund if payment has already been made.
No substitute item will be sent without the customer’s agreement.
- Prices, Taxes and Payment
Prices for products sold directly through the AKIZAKURA online shop are displayed in euros (€).
Prices include any taxes that AKIZAKURA is legally required to charge, where applicable.
Shipping costs are shown separately before the customer submits the final order.
Payment methods available at checkout may include credit or debit cards and payment options provided through Stripe, such as Apple Pay, Google Pay, Link, or other methods made available from time to time.
Payments are processed by Stripe or another payment service clearly identified at checkout.
AKIZAKURA does not directly store complete payment-card details on its website.
For deliveries outside the European Union, customs duties, import VAT, clearance charges, or other taxes may be imposed by the destination country. Unless expressly stated otherwise at checkout, such charges are the responsibility of the recipient.
The total amount payable by the customer will be displayed before the order is confirmed.

- Shipping and Delivery
AKIZAKURA ships from France.
Available delivery countries and shipping methods are displayed at checkout.
Orders are generally shipped using a tracked postal or delivery service, such as Colissimo, unless another delivery method is indicated.
The applicable shipping price is calculated according to the destination and the conditions displayed at checkout.
The delivery period or expected delivery timeframe applicable to the order will be communicated during the ordering process or in the order confirmation.
Customers must provide a complete and accurate delivery address.
If a parcel is returned because the customer provided an incorrect or incomplete address, additional shipping costs may be charged before the parcel is sent again.
AKIZAKURA remains responsible for the proper performance of its obligations relating to the order and delivery in accordance with applicable consumer law.
If a parcel appears to be lost, significantly delayed, damaged in transit, or delivered incorrectly, please contact AKIZAKURA at info@akizakura.net so that the matter can be investigated with the carrier and the appropriate remedy can be arranged.
French distance-selling rules require the seller to specify and respect a delivery period and make the seller responsible for proper performance throughout the order, transport, and delivery chain, subject to the legal exceptions. economie.gouv.fr
- Transfer of Risk
For consumer purchases, the risk of loss or damage normally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, subject to applicable law.
Customers should inspect the parcel and the item after delivery and contact AKIZAKURA promptly if there is a problem.
Failure to report a problem immediately does not remove any statutory rights that cannot legally be waived.
- Right of Withdrawal for Direct Online Product Purchases
Consumers purchasing products at a distance generally have a legal right to withdraw from the purchase without giving a reason.
For eligible direct purchases from the AKIZAKURA online shop, the withdrawal period is 14 days from the day on which the customer, or a third party designated by the customer other than the carrier, receives the goods.
To exercise this right, the customer must clearly inform AKIZAKURA of the decision to withdraw before the 14-day period expires.

After notifying AKIZAKURA of the withdrawal, the customer must return the item within 14 days.
Unless AKIZAKURA agrees otherwise or applicable law requires AKIZAKURA to pay them, return shipping costs are the responsibility of the customer.
A tracked return method is strongly recommended.

- Condition of Returned Goods
Customers may inspect an item in the same way they reasonably could in a physical shop.
The customer may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
AKIZAKURA therefore asks customers to handle vintage textiles carefully and return them in substantially the condition in which they were received.
The absence of original packaging does not automatically remove statutory withdrawal rights, although customers should use suitable protective packaging when returning delicate vintage textiles.
- Refunds Following Withdrawal
Where a valid statutory withdrawal applies, AKIZAKURA will refund amounts that must legally be reimbursed, including the product price and any applicable standard outbound delivery costs.
Additional costs arising because the customer selected a delivery method more expensive than AKIZAKURA’s standard delivery method do not have to be reimbursed where permitted by law.
The refund will normally be made using the same payment method used for the original transaction unless the customer expressly agrees otherwise.
AKIZAKURA may withhold reimbursement until the goods have been received back or until the customer provides evidence that the goods have been returned, whichever occurs first, where permitted by law.
French distance-selling rules provide a 14-day withdrawal period, require the customer to send the item back within 14 days after notifying withdrawal, and generally require the seller to refund the payment and applicable standard delivery costs within the statutory period. economie.gouv.fr
- Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply where an exception established by applicable law applies.
This may include, for example, products that have been made or substantially personalised according to the customer’s specifications.
A standard vintage item does not become non-returnable merely because it is vintage, pre-owned, discounted, or one of a kind.
Where an exception applies to a particular product, this will be stated clearly before the order is placed.

Le consommateur dispose d’un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d’apparition d’un défaut de conformité. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité et non la date d’apparition de celui-ci.
Lorsque le contrat de vente du bien prévoit la fourniture d’un contenu numérique ou d’un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d’apparition de celui-ci.
La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.
La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d’une extension de six mois de la garantie initiale.
Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.
Le consommateur peut obtenir une réduction du prix d’achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu’il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n’est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n’a pas droit à la résolution de la vente si le défaut de conformité est mineur.
Toute période d’immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu’à la délivrance du bien remis en état.
Les droits mentionnés ci-dessus résultent de l’application des articles L. 217-1 à L. 217-32 du code de la consommation.
Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d’un montant maximal de 300 000 euros, qui peut être porté jusqu’à 10 % du chiffre d’affaires moyen annuel (article L. 241-5 du code de la consommation).
Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Under French consumer law, the legal guarantee of conformity generally applies for two years from delivery, including to second-hand goods.
For second-hand goods, a lack of conformity appearing during the first 12 months is subject to the statutory presumption that it existed at the time of delivery, subject to the conditions and exceptions provided by law.
Depending on the circumstances, the consumer may have rights including repair or replacement and, where the statutory conditions are met, a price reduction or termination of the contract and reimbursement.
Because many AKIZAKURA items are unique vintage textiles, an identical replacement may not always be possible.
Any remedy will therefore be handled according to the applicable legal rules and the nature of the individual item.
Characteristics that were specifically and clearly disclosed before purchase are taken into account when assessing conformity.
The legal guarantee of conformity for second-hand goods applies for two years, with a 12-month presumption period for pre-existing defects in used goods. economie.gouv.fr
- Legal Guarantee Against Hidden Defects
The customer may also benefit from the French legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code where its legal conditions are satisfied.
A hidden defect is a defect that was not apparent at the time of purchase, existed before the sale, and makes the item unsuitable for its intended use or substantially reduces its usefulness.
The statutory action concerning a hidden defect must generally be brought within two years from discovery of the defect, subject to applicable legal rules.
Depending on the circumstances, the customer may be entitled to return the item for reimbursement or retain the item and request a reduction in price.
Visible characteristics, normal vintage wear, and characteristics specifically disclosed to the customer before purchase are not treated in the same way as undisclosed hidden defects. economie.gouv.fr

If an item must be returned in connection with a valid legal guarantee claim, AKIZAKURA will provide the appropriate return instructions.
The statutory legal guarantees apply independently of any optional commercial guarantee.
No clause in these Terms is intended to exclude or limit a mandatory legal guarantee.

- Purchases Through Etsy or Other External Marketplaces
Some AKIZAKURA items may also be sold through Etsy or another external marketplace.
When a customer completes a purchase through Etsy rather than directly through the AKIZAKURA website, the transaction is processed through Etsy’s systems and is also subject to the policies and conditions presented on Etsy.
Order communications, payments, returns, refunds, reviews, and certain dispute procedures may therefore be handled through the relevant marketplace.
Nothing in a marketplace policy removes any mandatory consumer rights that apply by law.
- Kimono Experience Services
AKIZAKURA may offer private kimono experiences in Paris.
Depending on the selected experience, the service may include:
- kimono or yukata dressing;
- an introduction to kimono culture and wearing etiquette;
- styling guidance;
- indoor or outdoor photo time;
- other elements described on the relevant booking page.
The precise content, duration, meeting arrangements, available garments, photography arrangements, and other conditions are those displayed for the selected experience or communicated in the booking confirmation.
The kimono experience is a cultural and leisure service. It is not a medical service, certified professional training course, or guarantee of formal bridal, theatrical, or commercial dressing services.
- Booking and Payment for Kimono Experiences
Bookings may be made through AKIZAKURA’s designated booking system, website, email, or another booking method indicated by AKIZAKURA.
A booking is considered confirmed when the customer receives confirmation and any required payment has been completed.
The price, payment method, cancellation conditions, rescheduling conditions, and other booking-specific rules displayed to the customer before payment form part of the contract.
Bookings made through GetYourGuide, Airbnb, Viator, or another external booking platform are also subject to the cancellation and payment rules applicable to that platform.
- Cancellation and Right of Withdrawal for Dated Kimono Experiences
A kimono experience booked for a specific date and time may qualify as a leisure activity to be provided on a specific date or during a specific period.
Where this statutory exception applies, the general 14-day right of withdrawal applicable to many distance contracts does not apply to the dated experience.
Instead, the cancellation and rescheduling policy clearly displayed before booking and included in the booking confirmation will apply.
Customers should therefore review the cancellation conditions carefully before confirming a reservation.
French consumer law includes leisure activities to be supplied on a specific date or during a specific period among the statutory exceptions to the general distance-contract withdrawal right. economie.gouv.fr
- Late Arrival
Customers who expect to arrive late should contact AKIZAKURA as soon as possible.
Where the customer’s late arrival reduces the time available for the experience, the scheduled finishing time may remain unchanged.
No refund or price reduction is automatically due where the experience is shortened because of the customer’s late arrival.
A significant delay may be treated according to the cancellation or no-show conditions applicable to the booking.
- Care of Kimono and Accessories During Experiences
Kimono, yukata, obi, accessories, and related items used during AKIZAKURA experiences remain the property of AKIZAKURA or the relevant owner or collaborator.
Customers are asked to handle all garments and accessories carefully.
Particular care should be taken around food, drinks, cosmetics, perfume, rain, mud, ink, sharp objects, cigarettes, and other substances or objects that may damage textiles.
Where serious damage, staining, or loss is directly caused by intentional conduct or serious negligence by a customer, AKIZAKURA may seek reasonable compensation for cleaning, repair, or replacement where permitted by law.
- Photography
Depending on the selected plan, the kimono experience may include photo time.
The number and type of photographs, whether editing is included, the method of delivery, and any other photography arrangements depend on the relevant experience description or individual agreement.
Customers may normally use photographs taken during their own experience for personal purposes and on personal social-media accounts, subject to the rights and privacy of other people.
AKIZAKURA will obtain appropriate permission before using identifiable customer photographs for AKIZAKURA advertising, social media, website content, or other promotional purposes.
- Customer Responsibilities
Customers are responsible for providing accurate information reasonably necessary to fulfil their order or booking.
For kimono experiences, customers are also responsible for arriving at the agreed place and time, following reasonable safety instructions, respecting the rules of venues and public spaces, and handling garments carefully.
Customers should inform AKIZAKURA before an experience of any relevant mobility, accessibility, or other practical requirement that may require reasonable preparation or adaptation.
- Limitation of Liability and Force Majeure
AKIZAKURA provides products and services with reasonable care and in accordance with applicable legal obligations.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
AKIZAKURA is not responsible for losses caused solely by the customer’s own actions or by circumstances that legally constitute force majeure.
Events such as severe weather, transport disruption, strikes, natural disasters, public authority restrictions, or other extraordinary circumstances outside the reasonable control of the parties may affect a service or delivery.
Where such circumstances occur, AKIZAKURA will take reasonable steps to communicate with the customer and comply with its legal obligations.
This section does not remove AKIZAKURA’s statutory responsibility for proper performance of consumer contracts.
- Intellectual Property
Unless otherwise stated, the texts, photographs, logos, branding, illustrations, designs, product descriptions, and other original content published on the AKIZAKURA website are owned by AKIZAKURA or used with permission from the relevant rights holder.
They may not be reproduced, copied, modified, distributed, or used commercially without prior permission, except where permitted by law.
- External Links and Third-Party Services
The AKIZAKURA website may contain links to external services and websites including Etsy, Instagram, WhatsApp, Stripe, booking platforms, or other third-party services.
Those services operate under their own terms and privacy policies.
AKIZAKURA is not responsible for the content or independent operation of external websites, except to the extent that applicable law provides otherwise.
- Personal Data
The collection and processing of personal data by AKIZAKURA are described in the AKIZAKURA Privacy Policy.
The Privacy Policy is available on the AKIZAKURA website.
Payment and order information may also be processed by WooCommerce, Stripe, shipping providers, and other service providers where necessary to complete a transaction.
- Contract Language
Contracts through the AKIZAKURA website may be offered in English and French according to the language version of the website or service used.
Where several language versions of these Terms are available, they are intended to describe the same contractual conditions.
Mandatory consumer protections applicable to the customer remain unaffected.
For transactions directed to consumers in France, the French-language information provided to consumers applies in accordance with French law.

Order confirmations and relevant contractual information may be provided and retained electronically.

- Governing Law
These Terms are governed by French law.
However, where the customer is a consumer residing in another country, this choice of law does not deprive the customer of mandatory consumer protections that apply under the law applicable to that customer.

Any dispute that cannot be resolved amicably or through an applicable consumer mediation procedure may be submitted to the competent courts in accordance with applicable rules on jurisdiction.

AKIZAKURA may update these Terms when necessary, for example because of changes to the website, products, services, payment methods, shipping arrangements, or applicable law.
The version applicable to an order or booking is the version made available to the customer at the time the relevant contract is concluded.
